M.P FINANCEMENTS, publisher of the www.votrecreditrapide.com site operated under the trading name « Votre Credit Rapide », attaches great importance to respecting your privacy. This policy explains what personal data we collect, why we process it, how long we keep it and which rights you may exercise, in accordance with Regulation (EU) 2016/679 (GDPR) and with Act no. 78-17 of 6 January 1978 as amended, known as the « Informatique et Libertés » Act.

2. Data we collect

Depending on how you interact with the site, we may process:

  • Identification data: surname, first name.
  • Contact details: email address, telephone number.
  • Data relating to your application: type of credit, amount wanted, term wanted, net monthly income, description of your project.
  • Data relating to your financial situation, where it is needed to assess the file: employment situation, outgoings and existing credits, repayment capacity.
  • Technical and browsing data: IP address, date and time a form is sent, browser type, pages viewed, to the extent necessary for the operation and security of the site.

Mandatory fields are marked on the forms: if you do not fill them in, we cannot process your request. We collect no sensitive data within the meaning of article 9 of the GDPR and our services are not aimed at minors.

The credit calculator runs entirely in your browser: the values you enter there are neither transmitted nor recorded unless you send an application.

3. Purposes and legal bases

  • Processing your credit application and getting back to you — performance of pre-contractual measures taken at your request (art. 6.1.b GDPR) and/or your consent (art. 6.1.a GDPR).
  • Seeking out and comparing suitable credit offers with our partner lenders — performance of pre-contractual measures.
  • Meeting our legal obligations as lender and as banking and payment services intermediary (duty to advise and inform, retention of files, anti-money laundering and counter-terrorist financing) — legal obligation (art. 6.1.c GDPR).
  • Ensuring the security of the site and preventing abuse — legitimate interest (art. 6.1.f GDPR).
  • Sending you marketing communications, where applicable — consent, which may be withdrawn at any time.

4. Recipients of the data

Your data is accessible to our authorised staff and, where this is necessary to process your request, disclosed to:

  • our partner lenders and insurers, acting as separate data controllers for the assessment of your file — list to be completed;
  • our technical processors (host, email provider, file management tool), acting solely on our instructions and bound by a contract compliant with article 28 of the GDPR — list to be completed;
  • the administrative or judicial authorities, where the law requires us to do so.

We neither sell nor rent your data to third parties.

5. Transfers outside the European Union

Your data is hosted and processed within the European Union. Should a transfer to a third country take place, it would only be to a country recognised as adequate by the European Commission or subject to the appropriate safeguards provided for in articles 44 et seq. of the GDPR (standard contractual clauses in particular), a copy of which you may obtain on request.

6. Retention period

Data is kept only for as long as is necessary for the purposes pursued:

  • Application with no follow-up (no credit concluded): period to be completed, from the last contact.
  • File that resulted in a credit agreement: period to be completed after the end of the agreement.
  • Accounting records and anti-money laundering evidence: period to be completed.
  • Marketing prospecting data: period to be completed, or until you withdraw your consent.
  • Technical connection and security logs: period to be completed.

7. Use of cookies

The site uses a session cookie that is strictly necessary for it to work (remembering the language chosen and securing the forms). In accordance with article 82 of the « Informatique et Libertés » Act, this cookie does not require your consent. 8. Security

We implement appropriate technical and organisational measures to protect your data against loss, misuse and unauthorised access: encrypted connection (HTTPS), access limited to authorised persons, protection of the forms against automated submissions and regular backups.

9. Your rights

In accordance with the GDPR and the « Informatique et Libertés » Act, you have the following rights:

  • the right of access to your data;
  • the right to rectification of inaccurate or incomplete data;
  • the right to erasure, within the limits of our statutory retention obligations;
  • the right to restriction of processing;
  • the right to object, in particular to marketing prospecting;
  • the right to the portability of your data;
  • the right to withdraw your consent at any time, without affecting the lawfulness of processing carried out before that withdrawal;
  • the right not to be subject to a decision based solely on automated processing producing legal effects concerning you;
  • the right to lay down directions on the fate of your data after your death (art. 85 of the « Informatique et Libertés » Act), whether general directions given to a digital trusted third party certified by the CNIL (the French data protection authority), or specific directions given to us.

Proof of identity may be requested where there is reasonable doubt as to who you are. We reply within one month, extendable by two months for complex requests.

11. Complaint to the CNIL

If, after contacting us, you consider that your rights are not being respected, you may lodge a complaint with the Commission nationale de l'informatique et des libertés (CNIL), the French data protection authority, 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07 — www.cnil.fr.

This policy may be adapted to take account of legal or technical developments. The applicable version is the one published on this page, whose update date appears at the top of the document.
