Terms of Use

1. Purpose

These terms of use (the « Terms ») set out how the www.votrecreditrapide.com site (the « Site ») may be accessed and used. The Site is published by M.P FINANCEMENTS, a SARL whose registered office is at 2 rue Donnat, 34430 Saint-Jean-de-Védas, France, registered under SIREN number 795 257 484. Full identification of the publisher appears in the legal notice.

The Terms govern only the use of the Site. They constitute neither the terms of a brokerage service nor the contractual terms of a credit: those appear in the pre-contractual and contractual documents provided, where applicable, by the intermediary and by the lender.

2. Acceptance of the Terms

Consulting the Site constitutes full and unreserved acceptance of these Terms. A user who does not accept all or part of these conditions must refrain from using the Site. The Terms are accessible at all times from the footer.

3. Access to the Site and availability

The Site is accessible free of charge to any user with an internet connection. Connection and equipment costs remain the user's responsibility.

The publisher endeavours to keep the Site available 24 hours a day, 7 days a week, without being bound by any obligation to achieve that result. Access may be interrupted, in particular for maintenance or updating operations or in the event of force majeure, without such interruption giving rise to any right to compensation. The publisher reserves the right to modify, suspend or remove all or part of the Site without notice.

4. User conduct

The user undertakes to use the Site in a manner that complies with the laws and regulations in force and with these Terms. In particular, the user must not:

  • provide false or inaccurate information, or information relating to a third party without their agreement;
  • disrupt the operation of the Site, undermine its security or test its vulnerabilities;
  • use a robot, a site harvester or any automated content extraction process;
  • publish content that is unlawful, defamatory, abusive or that infringes the rights of others;
  • send unsolicited advertising messages through the Site's forms;
  • reproduce or commercially exploit the content of the Site without authorisation.

The user is solely responsible for the accuracy of the information they submit, in particular when filing a credit application. Incorrect information may prevent the file from being assessed or distort the outcome.

5. Intellectual property

The structure of the Site and all of its components (texts, images, graphics, logos, trade marks, databases, source code) are protected by the French Intellectual Property Code (code de la propriété intellectuelle). Any reproduction, representation, adaptation, extraction or distribution, in whole or in part, on any medium whatsoever, is prohibited without the prior written authorisation of M.P FINANCEMENTS and would amount to an infringement punishable under articles L.335-2 et seq. of that same code. The user has only a right of consultation for private, non-commercial purposes.

6. Personal data

The data processing carried out from the Site (credit application form, contact form, technical logs) is performed in accordance with Regulation (EU) 2016/679 (GDPR) and with Act no. 78-17 of 6 January 1978 as amended. The purposes, legal bases, recipients, retention periods and the way in which you may exercise your rights (access, rectification, erasure, restriction, objection, portability, complaint to the CNIL, the French data protection authority) are set out in detail in our privacy policy.

7. Cookies and trackers

The trackers placed while browsing, their purpose and the ways of refusing them or withdrawing your consent are described on the cookie management page, in accordance with article 82 of the « Informatique et Libertés » Act.

8. Nature of the information published

The editorial content, rates, worked examples and simulation results presented on the Site are provided for guidance and have no contractual value. They constitute neither an offer of credit within the meaning of article L.312-12 of the French Consumer Code (code de la consommation), nor a promise to grant one. Every application remains subject to the assessment and approval of the file by the lender.

Credit is a commitment and must be repaid. Check that you can afford the repayments before you commit.

9. Liability

The publisher uses reasonable means to ensure the accuracy and updating of the information published, without guaranteeing that it is exhaustive, accurate or current at all times. The publisher cannot be held liable on account of a decision taken by the user on the sole basis of the information on the Site.

The publisher declines all liability for direct or indirect damage resulting from the unavailability of the Site, from a transmission error, from the presence of a virus or from an intrusion into the user's information system, the user remaining responsible for protecting their own equipment.

10. Hypertext links

The Site may point to third-party sites, in particular those of lenders or public authorities. Those sites are beyond the publisher's control, and the publisher assumes no liability for their content, their availability or their personal data practices. Creating a link to the Site requires the publisher's prior written agreement, and the publisher may ask for it to be removed at any time.

11. Changes to the Terms

The publisher may amend these Terms at any time, in particular to take account of legislative, regulatory or technical developments. The applicable version is the one online on the day the Site is consulted; the date of the last update appears at the top of the page. It is therefore advisable to review them regularly.

12. Complaints

Any complaint relating to the Site may be sent to contact@votrecreditrapide.com or by post to the registered office. The complaints procedure applicable to the brokerage activity and the contact details of the médiateur de la consommation (the French consumer ombudsman) appear in the legal notice.

13. Partial invalidity

Should any provision of these Terms be declared void or unenforceable, the remaining provisions would retain their full effect.

14. Applicable law and competent courts

These Terms are governed by French law. Failing an amicable settlement, any dispute falls within the jurisdiction of the French courts. The consumer may bring proceedings, at their choice, before the court of the place where they were living when the contract was concluded or when the harmful event occurred, in accordance with article R.631-3 of the French Consumer Code (code de la consommation).
